Private & Compliant by Design: VdoCipher Meets GDPR, DPDP & US Privacy Laws

When businesses evaluate a video hosting and DRM platform, the first question is usually about security: can the videos actually be protected from piracy? That is where VdoCipher started, and it remains the core of what we do: multi-DRM encryption, dynamic watermarking, and screen-capture blocking that keep premium content safe across web and mobile.

But over the last few years, a second question has become just as important, especially for enterprises, EdTech platforms, and media companies operating across borders: what happens to the personal data of our viewers? Security and privacy are related but not the same thing. A platform can be excellent at stopping downloads while still being careless with personal data. At VdoCipher, we have worked to make sure we are strong on both: secure by default, and private by design.

Here is how we think about it.

1. Privacy through data minimisation

The most reliable way to protect personal data is to not collect it in the first place. That principle sits at the heart of how the VdoCipher player works.

When a viewer watches a protected video, we process only a small, technical set of data needed to deliver and secure playback: the device’s IP address, device and technical details (operating system, browser, device type, DRM configuration), and a randomly generated anonymous user ID used for access control and abuse prevention. We do not collect or store your viewers’ names, email addresses, phone numbers, postal addresses, or payment details through the playback technology. We are not in the business of building advertising profiles of your audience, and we never sell or trade your data or your viewers’ data.

This matters because it changes the risk equation for you as our customer. The less personal data a vendor holds, the smaller the blast radius if something ever goes wrong, and the easier your own compliance obligations become. Data we never collect is data neither of us has to worry about.

There is one deliberate exception, and it is worth being transparent about. If you choose to enable the personalised visible watermark at your own will using our APIs or other form of integration: the feature that burns a viewer’s name or email onto the video to deter leaks ; then that name or email is sent to our API so we can render it. Even here we keep it minimal: that data is processed only in memory, for the short lifetime of the playback authentication request, and is discarded afterwards rather than being stored. And because you decide whether to use that feature and what to put in it, you remain the controller of that data. We document this flow precisely in our Data Processing Agreement so there are no surprises.

Alongside minimisation, the product itself is built with security controls that also protect data: encryption of content and of data in transit, least-privilege access for our team, secure hosting on reputable cloud infrastructure, logging and monitoring, and regular security testing. Good privacy and good security reinforce each other.

2. Built for GDPR, India’s DPDP Act, and US state privacy laws

VdoCipher serves customers in Europe, India, the United States, and beyond — and each region has its own rules for handling personal data. Rather than bolt compliance on as an afterthought, we have designed our contracts and processes to speak to all three major frameworks.

Europe and the UK (GDPR / UK GDPR). Under the GDPR, even an IP address or a persistent identifier is “personal data,” and processing it , even briefly , still counts. We take that seriously. Where your viewers are in the EEA or UK and their data is processed outside the region, we rely on the appropriate transfer mechanisms, including the EU Standard Contractual Clauses and the UK International Data Transfer Addendum, with the transfer details properly described so the safeguards actually cover the data flow. We act as your processor, handling data only on your documented instructions.

India (DPDP Act, 2023). As an India-incorporated company, VdoCipher is directly familiar with India’s Digital Personal Data Protection Act and its 2025 Rules. In that framework you are the Data Fiduciary and we are your Data Processor. We reflect India’s specific requirements ;including CERT-In cyber-incident reporting timelines and log-retention rules, and the DPDP Act’s negative-list approach to cross-border transfers, directly in our agreements, rather than forcing an EU-only template onto an Indian reality.

United States (CCPA/CPRA and state laws). For US customers, we contractually take on the role of a “service provider” under the California CPRA and equivalent laws in Colorado, Connecticut, Utah, Virginia and the growing list of other states. That means we commit not to sell or share personal information and to use it only to provide the services; with wording written to extend automatically as new state laws come into force.

The common thread is that you should be able to hand our documentation to your legal or compliance team and have it answer their questions, wherever you operate.

3. Enterprise Agreement, DPA, and EULA — the paperwork, sorted

Great privacy practices only help if they are backed by clear contracts. For customers who need them, VdoCipher provides a complete, ready set of legal documents:

  • Enterprise / Services Agreement : the main commercial contract covering scope of services, pricing, service levels and uptime, acceptable use, confidentiality, and a clearly defined liability position.
  • Data Processing Agreement (DPA) : the document your compliance team will look for. It sets out exactly how we process personal data on your behalf, covers GDPR/UK GDPR, the DPDP Act and US state laws in one place, and includes annexes describing the data, our security measures, our sub-processors, and the SCC/transfer mechanisms.
  • End User Licence Agreement (EULA) template : a viewer-facing template you can incorporate into your own terms, so your end users clearly agree to how the protected content and their limited playback data are handled.

Whether you are a mid-sized business or a large enterprise, you can get the specific combination you need, the Services Agreement on its own, or paired with a DPA and the EULA template; without a lengthy custom drafting exercise.

Security and privacy, together

Protecting your videos from piracy will always be VdoCipher’s job number one. But we believe you shouldn’t have to trade privacy for security, or wrestle with your vendor’s paperwork to satisfy a regulator. By collecting as little personal data as possible, designing for GDPR, DPDP and US privacy law from the ground up, and providing the contracts to prove it, we aim to make VdoCipher a platform your security team and your legal team can both sign off on.
